Where Can You Consume Cannabis in New York City?
Where NYC tobacco smoking rules overlap with cannabis, the exceptions, and the restrictions on parks, patios, businesses and vehicles.

Adults may generally smoke or vape cannabis where tobacco smoking is allowed, but not everywhere tobacco is permitted. Cannabis-specific restrictions and NYC smoke-free areas still apply.

The tobacco comparison has limits
OCM identifies private homes and many places where tobacco consumption is permitted, while excluding motor vehicles, private businesses such as restaurant patios, hookah or cigar bars, and federal property. Use the official rules for the actual place rather than treating tobacco permission as a complete test.

Outdoor does not automatically mean allowed
NYC’s smoke-free rules cover parks, beaches, pedestrian plazas and areas near hospital entrances. Restaurant and bar dining areas are smoke-free indoors and outdoors. The state rules also restrict smoking and vaping near school and library entrances and outdoor areas; check the linked guidance for the precise boundaries.

Cars and stores are not alternatives
NYC Health expressly includes parked motor vehicles in its cannabis smoking and vaping prohibition. Its guidance also excludes event spaces and businesses, including dispensaries. Buying at a legal retailer is not an invitation to consume inside.

Private accommodation needs a policy check
Ask about cannabis use and the method of consumption before booking or using a space. Residential buildings may have smoking policies, and indoor common areas of buildings with three or more units are smoke-free. A private room should not be confused with a shared lobby or hallway.
